利用規約 / Terms of Service
本利用規約（以下「本規約」）は、CloudPod（以下「本サービス」）の利用条件を定めるものです。本サービスは、運営者および提携クリエイターが配信する動画コンテンツをファンクラブ形式で視聴できる動画配信機能と、ユーザー自身が写真・動画・ファイルをクラウドに保存・管理できるストレージ機能を提供します。ユーザーは本サービスを利用することで、本規約に同意したものとみなします。
本サービスを利用するには、本規約に同意の上、所定の方法により登録を完了する必要があります。登録はGoogleアカウント、Apple ID、またはメールアドレスを使用して行うことができます。
本サービスは満18歳以上の方を対象としています。18歳未満の方はご利用いただけません。
ユーザーは、本サービスを利用するにあたり、自身が満18歳以上であること、およびお住まいの地域の法令上、本サービスのコンテンツの閲覧が許可されていることを表明・保証するものとします。本サービスは必要に応じて年齢確認を求めることがあります。
本サービスでは、運営者および提携クリエイターが動画コンテンツ（以下「配信コンテンツ」）を配信します。配信コンテンツの視聴権は、ユーザーの加入プランに応じて次のとおり付与されます。
配信コンテンツの視聴権は、ユーザーが有効な有料プランを維持している期間に限り、個人的かつ非独占的に付与される視聴のためのライセンスであり、配信コンテンツの所有権その他の権利がユーザーに移転するものではありません。
ユーザーは、本サービスの利用にあたり以下の行為を行ってはなりません：
本サービスでは、以下のコンテンツの投稿・配信を禁止します。これらに該当するコンテンツを発見した場合、当社は事前の通知なくこれを削除し、必要に応じて投稿者のアカウントを停止または削除することがあります。
利用者は、不適切なコンテンツを発見した場合、アプリ内の通報機能または [email protected] を通じて報告することができます。
本サービスは、ユーザーが写真・動画・ファイルをアップロードして保存・フォルダ管理できるストレージ機能を提供します。
CloudPodは、以下のいずれかに該当すると判断した場合、ユーザーへの事前通知なく本サービスの全部または一部の提供を停止・中断することがあります：
配信コンテンツ、ならびに本サービスを構成するソフトウェア、デザイン、ロゴ、商標その他一切の知的財産権は、運営者または正当な権利を有する配信元（クリエイター等）に帰属します。ユーザーは、本規約で明示的に許諾された範囲を超えて、これらを利用してはなりません。本条は、第6条に基づきユーザー自身がアップロードしたコンテンツの権利には影響しません。
CloudPodは、ユーザーが以下のいずれかに該当する場合、事前通知なく当該ユーザーの本サービスの利用を制限し、またはユーザー登録を抹消することができます：
本サービスは無料での利用に加え、有料プランを提供しています。動画視聴向けのゴールドプラン・ダイヤモンドプラン、およびストレージ向けのStandardプラン・Proプランがあり、いずれも自動更新サブスクリプションです。
CloudPodの故意または重大な過失による場合を除き、契約不履行に基づくCloudPodの責任は通常生じうる損害の範囲に限られます。本サービスおよび配信コンテンツは「現状のまま」提供されており、特定目的への適合性や、配信コンテンツが継続して提供されることを保証するものではありません。
CloudPodは、ユーザーへの事前通知なく本サービスの内容（配信コンテンツのラインナップを含む）を変更し、または本サービスの提供を終了することができます。これによりユーザーに生じた損害について、CloudPodは責任を負いません。
CloudPodは、必要と判断した場合には、ユーザーへの事前通知なく本規約を変更することができます。変更後の規約は、本サービス内に掲示した時点で効力を生じます。
当社は、登録ユーザーに対し、登録されたメールアドレス宛に、新着コンテンツ・お知らせ・キャンペーン等の販促メールを送信することがあります。ユーザーは、これらのメールについて、メール内に記載された配信停止の手段により、いつでも受信を停止することができます。
本規約の解釈および適用は日本法に準拠します。本サービスに関連して生じた紛争については、運営者の本店所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service ("Terms") govern the conditions of use for CloudPod ("the Service"). The Service provides a fan-club–style video streaming feature, through which video content distributed by the operator and partner creators can be viewed, as well as a personal storage feature that lets users save and manage their own photos, videos, and files in the cloud. By using the Service, you agree to these Terms.
To use the Service, you must agree to these Terms and complete registration using the prescribed method. Registration can be done via a Google account, Apple ID, or email address.
The Service is intended for users aged 18 and older. Users under the age of 18 are not permitted to use the Service.
By using the Service, you represent and warrant that you are at least 18 years of age and that viewing the Service's content is lawful in your jurisdiction. The Service may request age verification where necessary.
The operator and partner creators distribute video content ("Distributed Content") through the Service. Viewing rights to Distributed Content are granted according to your subscription plan, as follows:
Viewing rights to Distributed Content constitute a personal, non-exclusive license to view, granted only for the period during which you maintain an active paid plan. No ownership or other rights in the Distributed Content are transferred to you.
Users must not engage in the following activities when using the Service:
The following content is prohibited from being posted or distributed on the Service. If we discover content that falls under any of these categories, we may remove it without prior notice and, where necessary, suspend or delete the account of the user who posted it.
If you find inappropriate content, you can report it through the in-app reporting feature or at [email protected].
The Service provides a storage feature that allows users to upload, store, and organize photos, videos, and files into folders.
CloudPod may suspend or interrupt all or part of the Service without prior notice if any of the following circumstances apply:
The Distributed Content, as well as the software, design, logos, trademarks, and all other intellectual property comprising the Service, belong to the operator or the rightful distributors (such as creators). Users may not use them beyond the scope expressly permitted under these Terms. This Article does not affect the rights in content that users themselves upload under Article 6.
CloudPod may, without prior notice, restrict a user's access to the Service or cancel a user's registration if the user falls under any of the following:
In addition to free use, the Service offers paid plans: the Gold and Diamond plans for video viewing, and the Standard and Pro plans for storage. All paid plans are auto-renewing subscriptions.
CloudPod's liability for breach of contract is limited to the scope of damages that would normally arise, except in cases of CloudPod's intentional misconduct or gross negligence. The Service and the Distributed Content are provided "as is," and CloudPod makes no warranty of fitness for a particular purpose or that any Distributed Content will remain continuously available.
CloudPod may change the content of the Service (including the lineup of Distributed Content) or discontinue providing the Service without prior notice. CloudPod shall not be liable for any damages incurred by users as a result.
CloudPod may change these Terms without prior notice when deemed necessary. The revised Terms take effect when posted within the Service.
CloudPod may send promotional emails regarding new content, announcements, campaigns, and similar information to registered users at their registered email address. Users may stop receiving such emails at any time using the unsubscribe method described within each email.
These Terms shall be interpreted and applied in accordance with the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the operator's head office as the court of first instance.
